CASE HISTORY - Traffic Accident
On a rainy, misty day in December of 1998 Joey, a 28 year old
roofer with two children, was driving home from his brother’s
house after a Christmas visit. Up ahead in the foggy distance,
a county dump truck was making an improper U-turn. Out of nowhere,
the side of the truck suddenly appeared in front of him. In
an instant Joey's life changed forever. He slammed on the brakes
as his car slid underneath the truck at impact, trapping Joey
in the wreck.
Joey suffered severe injuries including an open reduction of
the fibula and now has a steel rod from knee to ankle. He will
have a limp for the rest of his life. He is unable to work in
the construction trade as he is permanently disabled.
Joey's attorney, an experienced sole practitioner in a small
town in North Carolina, prepared his case well and presented
the County with a demand letter seeking $800,000. The county
responded with an offer of $150,000.
Unable to work during his long and painful recovery, Joey had
no financial reserves and had borrowed all that his family members
could afford to lend him. He and his family were about to be
evicted from their apartment and, while the county had paid
for the property damage to his car (which was totaled), his auto
loan had negative equity so he had no way to acquire transportation.
One year after the accident, Joey was desperate and ready to
settle - until he called CapTran.
